1. Purpose
These terms govern the use of the zmlabs.net website and of the plugins published by ZM Labs (Victor ZAKRZEWSKI, EI, trading as Agence ZM), in their free and Premium versions, as well as the SafeAlt online service.
2. Software license
The plugins’ code is distributed under the GNU GPL version 2 or later, like WordPress. You may use, study, modify and redistribute it under the terms of that licence. The ZM Labs names, logos and graphic elements are not covered by the GPL.
3. Accounting Export for WooCommerce Premium license
- A Premium license gives access, for one year and for the chosen number of sites (1, 5 or 25), to the download of the Premium version, its updates and email support. The Premium version can be tried for free for 14 days; if the trial ends without a purchase, the Premium features switch off.
- It renews automatically every year unless cancelled from the customer portal.
- Without renewal, the plugin keeps working with all its features; updates and support stop.
- The purchase is made with Freemius, Inc., reseller, whose terms of sale apply to payment and invoicing.
4. Accounting use
Accounting Export for WooCommerce produces journal entry files from your shop’s data. The charts of accounts offered are starting points: the configuration and the exports must be validated by your accountant. Formats marked “beta” must be tested with a sample file before any production use. The user remains responsible for their accounting and tax filings.
5. SafeAlt service
- The service. The SafeAlt plugin, distributed under the GPL, connects to the SafeAlt online service operated by ZM Labs, which writes texts (alternative text, title, caption, description) from the images you choose to send it.
- Plans and quota. Each plan includes a number of images per month and a number of sites. The quota renews every month; only images described successfully are counted, and unused images do not roll over. When the quota is reached, processing is suspended until the renewal.
- Subscription. Paid plans are taken out in the plugin and sold by Freemius, Inc., reseller, whose terms of sale apply to payment and invoicing. A cancellation takes effect at the end of the current period. A full refund can be requested within 14 days of each payment, in line with the refund policy.
- Availability. The service runs in the background, with no guaranteed processing time. ZM Labs strives to keep it running but may interrupt it for maintenance or in case of force majeure.
- Generated texts. Texts are generated automatically and may contain errors. You remain responsible for reviewing and publishing them, especially results flagged “to check”.
- Content sent. You guarantee that you hold the rights to the images sent. It is forbidden to send unlawful content to the service, as well as adult or sexual content. Data processing is described in the privacy policy.
- Free account. Only one free account is allowed per site. Circumventing the free quota is forbidden, in particular by multiplying sign-ups, site addresses or direct calls to the service.
- Abuse. If these rules are breached or the service is abused, ZM Labs may suspend or terminate the account concerned, after a warning except in urgent cases. To report abuse: contact@zmlabs.net, subject “Abuse report”.
6. Warranties and liability
6.1 No warranty. The plugins are developed with care. The free version is provided “as is”, without warranty of any kind, in accordance with sections 11 and 12 of the GPL. For the Premium version, the publisher undertakes to provide the updates and support described on the website for the duration of the license; it does not warrant that the software is error-free or fit for a particular purpose.
6.2 User responsibilities. The user is solely responsible for: configuring the plugin and having it validated by an accountant; checking exported files before importing them and before any filing; their accounting, tax and social filings; regular backups of their site and data; the compatibility of their environment (hosting, PHP, WordPress and WooCommerce versions, other plugins); testing formats marked “beta” beforehand.
6.3 Limitation of liability. To the fullest extent permitted by law, the publisher shall not be liable for any indirect or consequential loss, including loss of data, revenue, profit or customers, filing errors or delays, tax reassessments, penalties, surcharges or fines, business interruption, or the consequences of an entry error not detected by the user or their accountant. For business users, the publisher’s total liability, for all causes combined, is limited to the amount actually paid for the license or subscription concerned during the twelve months preceding the event giving rise to the claim; it is nil for the free version. The publisher is not responsible for third-party services (hosting, WordPress, WooCommerce, payment gateways, Freemius, accounting software).
6.4 Legal limits. These limitations do not apply in case of gross negligence or wilful misconduct, nor to personal injury, and do not deprive a consumer of the rights granted to them by law that cannot be waived.
7. Use of the website
The content of the website is provided for information. It is forbidden to disrupt its operation or to extract its content automatically on a large scale.
8. Governing law
These terms are governed by French law. In case of dispute, an amicable solution will be sought first. Consumer mediator and competent court: to be announced.
